Judkin 3D LLC (Judkin3D) Tuning Waiver and Release of Liability
Please read this waiver carefully. You must accept it before booking any tuning service. By checking the waiver box when you book, you confirm that you have read, understood and agree to everything below.
1. The risks of tuning
Engine tuning involves real risk. Changing fuel, ignition, boost and other ECU settings, and running an engine at high load on a dyno or on the road, can cause engine, drivetrain or other vehicle damage, even when the work is done carefully and correctly. You understand and accept these risks.
2. Your vehicle's condition
Our tunes are built on the assumption that the vehicle and all of its parts are in good mechanical condition and installed correctly. You are responsible for the condition of your vehicle, including the engine, fuel system, ignition, cooling, wiring, sensors, and any modifications. We may check basic running condition before tuning, but that check does not guarantee the overall condition of the vehicle. Failures caused by worn, faulty, incorrectly installed or undersized parts are not our responsibility.
3. Remote tuning
For remote tuning, you or your chosen shop handle all physical work on the vehicle, including wiring, installation, driving, data logging and dyno operation. You are responsible for operating the vehicle safely, and for the shop and dyno you choose. Internet dropouts, laptop problems and other issues outside our control can happen during a session.
4. Off-road and competition use
Our tuning services are intended for off-highway, track and competition vehicles. Modifying a vehicle's engine management may not be legal on public roads where you live, including under emissions and vehicle safety laws. Meeting all federal, state and local laws for your vehicle is your responsibility. If you test or drive your vehicle on public roads, you agree to obey all traffic laws and do so at your own risk.
5. Manufacturer warranties
Tuning or modifying a vehicle may void or affect its factory or extended warranty. Judkin3D is not responsible for any loss of warranty coverage, or for any costs that result from it.
6. Results
Power, drivability and fuel economy depend on your engine, parts, fuel and conditions. We do not guarantee any specific horsepower, torque or other result.
7. Release of liability
To the fullest extent allowed by law, you release Judkin 3D LLC and its owners, employees and contractors from all claims, damages, losses and expenses related to the tuning services. This includes damage to the vehicle or other property and any personal injury, whether or not it was caused by negligence. You agree that this release is an essential part of this agreement.
8. No warranty
Tuning services are provided as-is. Judkin3D makes no warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose.
9. Indemnification
You agree to defend, indemnify and hold harmless Judkin 3D LLC from any claims by you or anyone else, including passengers, other drivers, dyno shops and later owners of the vehicle, that arise from the tuning services or from use of the tuned vehicle.
10. Refunds
Tuning is a custom service, and time spent tuning cannot be returned. Completed tuning sessions are non-refundable. If you need to reschedule a session, please contact us as early as possible.
11. Agreement
By checking the waiver box and booking a tuning service, you confirm that you are the owner of the vehicle or authorized by the owner, that you are at least 18 years old, and that you agree to this waiver. If any part of this waiver is found unenforceable, the rest remains in effect.
